Town of Hortonia Rezoning and Variance Request Form.

NOTE: Include maps, plans, etc. that may be helpful in the Town Board’s decision. Fee is $300 (see Fee Schedule ordinance) made payable to TOWN OF HORTONIA at time of request. Return form to the Clerk at the address listed on the form. Once your submission and documents are received (establishing the filing date), your request will be reviewed by the Planning Commission (rezonings) or Board of Appeals (variances). Rezoning requests require Town Board and then County Board Approval. Board of Appeals rulings do not require approval unless otherwise indicated by ordinance. You and the adjoining property owners will be notified of the meeting(s).

To obtain Names & Addresses of Adjoining Property Owners, we recommend browsing the OLI GIS (Outagamie Land Information Geographic Information Server) web site at http://www.co.outagamie.wi.us/planning/Maps_main.htm After choosing "OLI Property Tax Data" from this site, you can enter your parcel number, then click the "Buffer Selection" icon (it looks like a small yellow and white tic-tac-toe drawing). After clicking this icon, you can specify the distance around your parcel (example: 100 feet), then press the [Submit] button. You will then get a MAP and LIST of adjoining property owners. From this point, you are given the option to [Print] or [Download] the information. Presently, if you click [Download] you will get a CSV (comma separated value) file that lists all the adjoining property owners.

Variance procedure (not more than 60 days from date of filing):

  1. Applicant contacts Building Inspector regarding request
  2. Applicant completes form getting help from Building Inspector as needed
  3. Applicant submits fee payment and form
  4. Clerk receives form, supporting documents and fee payment (this establishes the filing date)
  5. Building Inspector refers variance request to Board of Appeals (per Town Zoning ordinance §1.09)
  6. Board of Appeals Chairman contacts members to schedule a date & time for the public hearing
  7. Clerk publishes Class 2 notice of public hearing in the paper, and, gives written notice to all adjacent property owners
  8. Clerk sends copies of paperwork to Board prior to the hearing
  9. Board of Appeals meets (not more than 60 days from filing date to public hearing) at the Town Hall on the specified date/time to act on the request

Rezoning procedure (this takes even longer):

  1. Applicant contacts Building Inspector regarding request
  2. Applicant completes form getting help from Building Inspector as needed
  3. Applicant submits fee payment and form
  4. Clerk receives form, supporting documents and fee payment (this establishes the filing date)
  5. Clerk refers zoning change request to Plan Commission (per Plan Commission ordinance §13(2) )
  6. Plan Commission Chair contacts members to schedule a date & time for the public hearing
  7. Clerk publishes 30-day Class 2 notice of public hearing in the paper, and, gives written notice to all adjacent property owners
  8. Clerk sends copies of paperwork to Commissioners prior to the hearing
  9. Plan Commission meets at the Town Hall on the specified date/time to act on the request
    • state statutes require that rezoning requests must be consistent with the future land-use map
    • rezoning requests that are not consistent will be denied
    • applicant's recourse is to petition for a change to the future land-use map to make it consistent with the proposed zoning change
  10. Plan Commission action is forwarded to the Town Board
  11. Town Board action is forwarded to County Zoning Committee
  12. County Zoning Committee action is forwarded to County Board
  13. County Board action is not official for a week allowing time for objection
