Minutes 2010 DEC 14 Monthly Board Meeting

Minutes of December 14 Town Board Meeting include:

  • Pledge of Allegiance recited. Meeting, called to order at 7:00 pm by Chairman John Jaeckle, had Board member Nancy Willenkamp and Bob Luedtke present; also present, Treasurer Marilyn Martin and Clerk Andrew Hogan; Constable Kevin Clegg absent. Four others present, including Plan Commission Chairman David LeMahieu, Board of Appeals Chairman Dick Stauss, Outagamie County Treasurer Dina Mumford and Outagamie Co. Hwy. Dept. Patrol Superintendent Dan Nejedlo. 
  • Board verified that public notice of meeting was given on the Town’s answering service 779-9780 and www.townofhortonia.org with agenda posted online, Town Hall, Fire Hall and Modern Flooring.
  • Luedtke motioned, seconded by Willenkamp, to approve minutes of November 9 Board meeting as posted. Carried.
  • Treasurer gave report, then introduced Mumford to speak about the tax bill issue. Mumford explained that manufacturing personal property parcel 120 99902000 was created this year with assessed value of $7,459,900 and accidentally coded as 44 2583 instead of 68 3955 by county personnel. In layman’s terms, a significant tax base was erroneously assigned to Hortonville Area School District rather than New London. This caused Hortonia residents in HASD to see a 13% reduction in school taxes at the expense of residents in SDNL who experienced significant increase. The error was caught by town officials, but unfortunately it was not in time to prevent two sets of tax bills from going out, one with the error and one revised, correcting the error. County Treasurer’s Office offered to field questions about the situation at 832-5065 and picked up the entire cost of the revised bills & mailing.
  • Residents are asked to please disregard the first tax bill. If you’ve already paid the first bill, please include a note with your second bill to tell us what you prefer we do with your first check(s). Some people are sending a new payment and asking Treasurer to shred, disregard, or return first one. Other people are sending a second check to make up the difference. By law all tax payers are required to pay the amount indicated by the second (revised) tax bill. Mumford explained that Martin was not responsible for the tax bill issue, apologized for the error and indicated new procedures are now in place to prevent the error from happening again.
  • Jaeckle asked for clarification on another tax issue – Wi Dept. of Revenue chargeback determination figures pertaining to the Sara Lee refund. Mumford explained WiDOR’s method. Clerk explained that final determination will not change Sara Lee refund, but will require some tax jurisdictions to pay additional amounts to Hortonia which would allow Hortonia to reimburse those jurisdictions that overpaid relative to WiDOR’s final determination.
  • Board heard from Nejedlo explain county’s procedure for plowing snow. County plows are dispatched from garage located in Village of Hortonville; road salt, also. Trucks plow county roads first. During second pass, while plowing shoulders, county trucks plow town roads. This eliminates backtracking and allows county to bill Town only for time spent plowing, not transit time between town roads. Some town roads, like Kelly Drive, get higher priority due to icing on hill which causes hazard for school bus. Givens, Winchester and Cross Rd, carrying heavier traffic, also get higher priority. In agreement with Town Chairman, county will let town roads accumulate some degree of snow before plowing in order to minimize the number of trips, which helps keep costs down.
  • During heavy snowfall, county plows are busy trying to keep county roads clear so town roads may not get attention until snowfall tapers-off. If town roads are snow-covered but passable near the end of the storm, plows wait until accumulation has subsided before making final passes, as was the case on Sunday when some residents called with complaints about drifts.
  • Replying to Willenkamp’s question, Nejedlo stated plowing driveway snow across a public road is against the law. Violators are warned, initially, then issued citations by sheriff if situation persists. Nejedlo explained that if county hits mailbox with plow, driver will return to repair the mailbox. However, mailboxes should be able to withstand being hit with snow. County will not repair mailboxes or reimburse damages from snow thrown by plow.
  • Responding to Luedtke’s question, Hogan indicated that Lyn Neuenfeldt expressed interest in Clerk position; has knowledge of election procedure as inspector; has been helping update website with past minutes. As of 12/14 only Marilyn Martin has submitted nomination paperwork to Clerk. Deadline for submission is 1/4/2011 for anyone seeking elected position: Board Supervisor, Chairman, Treasurer, Clerk or Constable.
  • Chairman noted summary of meetings attended by officials between 11/1 and 12/14 on agendas: Jaeckle (6), Luedtke (3), Willenkamp (4), Hogan (5), Martin (3), Plan Commissioners (1) Board of Appeals (1).
  • Board discussed the supplemental determination regarding Norman Hanson testimony, with Luedtke summarizing background and reading the four findings and determinations from the document submitted to circuit court regarding case 09-CV-902. Board sustained its pervious decision stating “previous findings and conclusions are unchanged.”
  • Board discussed Attorney’s Chudacoff and Carlson letters regarding Esselman request to replace 6” tile with 8” tile based on original permit allowing installation of 6” tile under Givens Rd. Jaeckle motioned, seconded by Luedtke, to predicate approval of a permit on submission of additional information including the original permit authorizing the 6” tile under Givens Road, and, engineering drawings delineating the location of 8” tile along with all engineering / architectural documentation expressing the work to be done. Carried – 3 ayes, 0 nays. Board directed Clerk for Atty. Carlson to write letter to Esselman reflecting Board’s action.
  • Board reviewed ordinance O2010.12.1 regulation of 911 address signs, directing Clerk to strike clause giving constable and building inspector authority to enforce violations, making section consistent with neighboring municipalities. Willenkamp motioned, seconded by Luedtke, to approve O2010.12.1 subject to clause revision. Carried – 3 ayes, 0 nays. Willenkamp cautioned Board to not install posts prior to contacting digger’s hotline.
  • Board debated color scheme for order of 455 20” x 8” double-faced flag high intensity prismatic 911 address signs. Jaeckle reviewed Lange, Decker and Rent-a-flash quotes. Willenkamp motioned to procure white signs with green lettering. No second. After further debate about which color schemes reflect best in various seasons and weather [blue with white lettering favored by HHFD Chief Dorn & Asst. Chief Bellile] and Board’s desire to differentiate Hortonia’s signs from neighboring municipalities, Willenkamp motioned, seconded by Luedtke, to procure green signs with white lettering from Lange. Carried – 3 ayes, 0 nays.
  • Board reviewed list of 455 signs including street names with consensus to proceed, subject to revising ‘Woodduck’ to ‘Wood Duck’. Board directed Clerk to forward list to Lange.
  • Clerk explained that ordinance O2010.12.1 could not be crafted to differentiate fees for residents vs. non-residents based on attorney general opinions and case law. Luedtke motioned, seconded by Willenkamp, to approve O2010.12.1 Notice of Records Access. Carried – 3 ayes, 0 nays.
  • Action on resolution R2010.12.1 postponed to next meeting due to another mapping error discovered, yesterday.
  • Board discussed options for Spring Newsletter in light of timing of pending overhaul of zoning ordinance including working lands initiative provisions regarding Ag district. Town officials to write articles regarding zoning ordinance, land division / subdivision ordinance, tax bills, new 911 address signs, rafts, recycling and garbage, the Town Hall, and more. Target dates: Newsletter approved at 2/8/2011 Board meeting and mailed out 2/10/2011.
  • Action on transferring money from general budget to contingency account postponed.
  • Willenkamp motioned, seconded by Luedtke, to pay the bills as printed. Carried – 3 ayes, 0 nays.
  • Meeting adjourned 8:45pm. Next regular Board meeting: Tuesday, January 11, at 7:00 pm.
