Minutes of August 3 Board of Appeals Hearing include:
- Meeting called to order at 7:32 pm by Board of Appeals (BOA) Chairman Dick Stauss, had Board members Randy Dorow, Glenn Gradl, Dave Kriesel, Lee Marks and alternate Chad Karpf present; also present, Clerk Andrew Hogan and applicant for the variance Terry Carothers. One other was also present.
- BOA verified that public notice of hearing and agenda were posted at Town Hall, Fire Hall, Modern Flooring, www.townofhortonia.org, and notice given on Town’s answering service 779-9780. Class 2 notice was published in Post Crescent. Property owners within 300 ft radius also given written notice on July 19th.
- BOA appointed Clerk Hogan as Secretary.
- Stauss introduced Board members; stated the purpose of the BOA hearing was to consider the applicant’s request for a variance for a second driveway; reviewed procedure including requirement of four or more aye votes in order to approve variance.
- BOA heard from Carothers presenting arguments in favor of his petition for the variance, citing hardship of not being able to safely store camper and other belongings; citing safety concerns from backing on/off Givens Rd given high speed of traffic; citing unique limitation of property dropping off into ravine; citing support form neighbor.
- Stauss stated 3 criteria need to be met for variance to be approved: unnecessary hardship, unique property limitations, no harm to public interest.
- BOA heard from Craig Jordan seeking information from variance application and clarification on jurisdiction.
- Carothers fielded questions from BOA members regarding building setbacks, driveway length, safety, traffic and existing apron.
- BOA acted on resolution to decide Carothers’s petition for variance. Approved – 5 ayes, 0 nays.
- Dorow motioned, seconded by Marks, to adjourn. Carried. Meeting adjourned 7:46pm.
