2008 February 12 Ordinance - An Ordinance Amending the Town of Hortonia Zoning Ordinance to Provide for Conservation Subdivisions in the RE & R-1 Zoning Districts

The ordinance establishes the following:
1. The following definition shall be added in the Definitions Section 1.03(2) as subparagraph, 16n in the Town of Hortonia Zoning Ordinance:

  • Conservation Subdivision. A housing development in a rural setting that is characterized by compact lots and common open space, and where the natural features of land are maintained to the greatest extent possible.

2. The following provision shall be added in R-1 Residential District, Section 1.05(4)(b), Permitted Uses, as subparagraph 4:

  • Conservation subdivisions, provided the average density does not exceed one lot per three acres; minimum lot size shall be 24,000 square feet; maximum lot size shall be one acre; minimum lot width shall be 100 feet; minimum front yard (setback) 50 feet; minimum side yards 20 feet each; and minimum rear yard 40 feet. The remaining open space shall be preserved in perpetuity by a recordable instrument approved by the Town of Hortonia.

3. The following provision shall be added in RE Rural Estate District, Section 1.05(3)(b), Permitted Uses, as subparagraph 5:

  • Conservation subdivisions, provided the average development density does not exceed one lot per seven acres; minimum lot size shall be 40,000 square feet; maximum lot size shall be two acres; minimum lot width shall be 150 eet; minimum front yard (setback) 50 feet; minimum side yards 25 feet each; and minimum rear yard 50 feet. The remaining open space shall be preserved in perpetuity by a recordable instrument approved by the Town of Hortonia.
