This is the most recent update to the ZO update. Draft is as yet unapproved and still in the process of review. Minor changes made to this new version will be noted in the minutes of the Planning Commission. Until this Draft is given the final approval by the Town Board, all issues that pertain to zoning are governed by the current (old) ZO.

Ordinance No. O2011.01.2 – The Board of Supervisors of the Town of Hortonia does ordain as follows:

The Town of Hortonia Land Division Ordinance, December 4, 2001 as amended is hereby repealed in its entirety.
The regulations entitled “Land Division and Subdivision Regulations, Town of Hortonia, Outagamie County, Wisconsin,” (January 6, 2011) attached hereto are hereby adopted.
This Ordinance shall take effect upon publication [on January 12, 2011].

Ordinance O2010.12.2 - Notice of Records Access

This ordinance, adopted on December 14, 2010, defines a procedure and fee schedule for open records requests. It is an ordinance that is required by state statutes. Town of Hortonia residents are welcome to give their input to Town Supervisors to insure that the ordinance gives them access to Town records, while protecting them from predatory outside entities; both in terms of the scope & quantity of the data requested, and, cost to the Town for providing such data. Town residents may refer state statutes and state Attorney General's media resources availed August 27, 2010 as follows:

Ordinance: Election Split Shift

Ordinance O2010.09.1 - An Ordinance Establishing Split Shifts for Election Officials

This ordinance, adopted September 9, 2010, allows poll workers to work ½ days and gives the clerk the flexibility to schedule additional election inspectors to serve as greeters if needed. The Board of Supervisors of the Town of Hortonia, Outagamie County, Wisconsin, has the specific authority under §7.30(1) stats., to adopt this ordinance.

Ordinance: Appointed Clerk

Ordinance O2010.08.1 - An Ordinance Establishing an Office of Town Clerk to be filled by Appointment upon Referendum Approval

This ordinance, adopted August 10, 2010, is required 45+ days prior to referendum vote pursuant to Wis. statutes §60.30(1e) in order for Hortonia voters change the office of the Town Clerk from an elected position to an appointed position. Minutes of the May 11 monthly Town Board meeting reflect that the Board chose to place the referendum on the November 2, 2010 ballot. At the Town’s Annual meeting held April 13, 2010 the electors approved a motion to put a referendum on the ballot, either this September or November, to allow Town electors to choose whether they want an appointed clerk or an elected clerk. The motion carried by a vote of 12 ayes to 7 nays.

The April 13, 2010 minutes regarding this issue reflect the following:

Electors reviewed a draft ordinance changing the Town Clerk from an elected to appointed position. Clerk explained he is not seeking re-election; in 2009 there were no candidates on the ballot for Clerk; changing to appointed position increases size of pool of candidates to people outside Township; allows Board to require qualifications; other pros/cons discussed. Atty Carlson weighed in that Towns of Greenville, Caledonia, Maple Creek, Clayton and Village of Hortonville are appointed; confirmed change requires a referendum be put on the ballot. Electors expressed concern about losing direct control over choosing the clerk; about part-time position becoming full time; about increased cost including benefits.
Glenn Marks motioned, seconded by Dennis Clegg, to table changing the position of clerk from elected to appointed, to the next annual meeting. Motion failed – 7 ayes, 9 nays.
Reta Wirth motioned, seconded by David LeMahieu, to put a referendum on the ballot, either this September or November, to allow Town electors to choose whether they want an appointed clerk or an elected clerk. Carried – 12 ayes, 7 nays.

The referendum question shall be: “Shall the person holding the office of Town Clerk in the Town of Hortonia be appointed by the Town Board?”

Voting YES means you favor changing the position to Appointed
Voting NO means you favor keeping the position Elected

On November 2^nd the referendum FAILED with 275 (60.6%) voting NO to 148 (32.6%) voting YES out of 454 total ballots cast. !! CLICK HERE !! for election results.

Ordinance: Amendment to Official Map

2010 April 28 Ordinance O2010.04.1 - An Ordinance Amending the Official Map of the Town of Hortonia regarding the Western extension of River Road in part of the SW ¼ of the NE ¼, part of the NW ¼ of the SE ¼ and part of the SE ¼ of the NW ¼ all being located in Section 19, T22N, R15E, Town of Hortonia, Outagamie County, Wisconsin.

Purpose: The purpose of this ordinance is to amend the Town of Hortonia Official Map by adopting a revised description and map of the western extension of River Road.

Note: A Certificate of Adoption of this ordinance is recorded with the Outagamie County Register of Deeds - document 1873212.

2010 May 11 Ordinance O2010.05.1 - Town of Hortonia Plan Commission Ordinance

Purpose: The purpose of this ordinance is to establish a Town of Hortonia Plan Commission and set forth its organization, powers and duties, to further the health, safety, welfare and wise use of resources for the benefit of current and future residents of the Town and affected neighboring jurisdictions, through the adoption and implementation of comprehensive planning. Adoption of this ordinance shall repeal and replace the ordinance adopted March 9, 2010 entitled, “AN ORDINANCE ESTABLISHING A PLAN COMMISSION FOR THE TOWN OF HORTONIA.”

Adopted May 11^th, 2010 and published May 12^th, 2010, this ordinance repeals and replaces the Plan Commission ordinanced adopted March 9, 2010.

2011 January 6 Ordinance - Land Division and Subdivision Regulations, Town of Hortonia, Outagamie County, Wisconsin.

The first draft ordinance was presented by Jeff Sanders of Community Planning and Consulting to the Town Board and Plan Commission on March 9th, 2010 - !! CLICK HERE !! for minutes.

A 4^th draft ordinance was provided by Jeff Sanders to the Plan Commission on 11/1/2010. This draft was recommended by Plan Commission resolution to the Town Board.

This document was created from that 4^th draft, as revised subsequent to input at the public hearing held 1/6/2011, and Town Board action of 2/8/2011 (requiring minor revisions for Act 376 compliance). !! CLICK HERE !! for minutes from the public hearing held January 6, 2011.

This set of regulations replaces the old Conservation Subdivision Ordinance and Land-division Ordinance.

2009 July 14 Ordinance O2009.07.1 - Fee Schedule Ordinance for the Town of Hortonia, Outagamie County, State of Wisconsin

Purpose: To establish a fee schedule wherein all fee requirements in connection with permits and licenses are consolidated in a single ordinance. Adoption of this ordinance shall repeal and replace the Town of Hortonia Fee Schedule Ordinance adopted June 7th 2005.

Building Permits
1. $700 - New Residential Single-family Dwelling
2. $800 - New Residential Two-family Dwelling
3. $400 per unit - New Residential multi-family (3 or more) Dwelling
4. $400 - Residential Additions (over 150 Sq. Ft)
5. $200 - Res. Remodeling Projects (under 150 Sq. Ft.)
6. $200 - Res. Garages (Not part of the Family Dwelling)
7. no fee - Decks
8. $50 - Res. Accessory Buildings exceeding 300 Sq. Ft
9. $50 - Alterations to Buildings in excess of $2000
10. $100 - AG Buildings - Garages/Barns

Authority: Pursuant to authority granted under Section 66.0113 of the Wisconsin Statutes, the Town Board of Supervisors of the Town of Hortonia hereby authorizes the use of a citation to be issued for violations of ordinances, including ordinances for which a statutory counterpart exists.
